Well the Best Interest Assessor S that was involved in my Husbands DOLS certainly needs a harsh reality check.
I got a call from her one afternoon and she made a conclusion in 15 minutes that I did not have the Capacity to become my Husbands Relavant Persons Advocate.
She based this on my chronic long term medical problems as well as working more or less full time as a Nurse
Her stance was that I was wrapped up in my own health issues as I was waiting for surgery and was in chronic pain for most of the time.
She said that if I did not go along with what she wanted she had the power to stop me going to see my Husband in a Local Care home.
I told her .that I was well aware of this because I had dealt with adult service cases where Family were denied seeing there loved one in a Psychiatric Unit.
The report arrived and S reccomendec that I should not become RPA .reasons stated she stated that in her opinion I could not do things in my Husband best interest because I was suffering from depression.
I wrote a letter of complaint to the LA DOLS team and kept the pressure on.
In the end after many phone calls the LA backed down and said that I could become my husband RPA .if I agreed to be assisted by a 39D IMCA.
But I had to be very proactive and contact the IMCA myself which was a job and a half,
After various complaints she eventually contacted me and asked if I knew the process to be honest I know the process a hundred percent more than her.
She asked me if I needed any legal representation I told her flatly no and had a good list of Solicitors at PAIN.
The whole situation left me a miserable wreck over the constant battle with the LA and BIA.
Clearly they were breaking all the DOLS Guidance in the book.because it is usually a Family Member that takes on the role of RPA.she was clearly very vindictive with me and was using her threats to deny me taking on the role.
A 15 minute call on the telephone and deemed me a dim wit obviously .
Once again by my strong Charecter and with the stance of I will fight for what is right.
The LA held their heads down .i think to be honest they could not. deal with me challenging them in every direction and using case law to define my rights.
